DU BOIS PROPOSES MOTION OF CENSURE AGAINST SUTCLIFFE

At the meeting of the eThekwini Council on May 29, Bluff DA ward councillor Duncan Du Bois is to propose
a notice of motion against Municipal Manager Dr Michael Sutcliffe. The motion is based on section 195 of
the constitution which requires that officials in public service must render services ' impartially and without
bias.'

' Underlying the values, principles and provisions of chapter 10 of the Constitution which deals with public
administration is the intention to facilitate good governance. The sections referred to in this Motion
distinguish clearly between service to the state and service to a political party,' said Cllr Du Bois.

'In his statements published in the Daily News of April 30, 2007, Dr Sutcliffe showed scant regard for
impartiality as regards the controversy caused by the flawed street renaming exercise. In terms of section
195 of the Constitution he may not discriminate against any sector of the population, regardless of his own
particular political leanings. Yet by attempting to disparage those who objected to street renaming and to
certain of the names proposed, as " right wing people," Dr Sutcliffeviolated that constitutional provision as
regards public administration,' said Du Bois.

' In that a municipal manager is the foremost official in a local government structure, this Notice of motion
is, arguably,the most serious and significant one ever placed on an agenda in this city.'

' This is so because it amounts to a motion of censure of the Muncipal Manager.
As such it is historic  because there is no precedent in Durban's municipal history going back to 1854 of
such a motion ever being necessary.'

' Sadly, it is also historic because as a motion of censure it is overdue. Since he took up the position of
Municipal Manager Dr Sutcliffe has regularly disregarded the provisions of section 195 (1) (e) of the
Constitution as regards impartiality and acted as if he was the principal driver of the ruling party's political
agenda,' said Cllr Du Bois.

News Update
#  Municipal manager Mike Sutcliffe survived the motion of censure moved on May 29 against him
by Cllr Du Bois when the ANC defeated it.

But although the vote was lost the debate was won. ANC arguments against the motion included
such ridiculous claims as accusing the DA of influencing the journalist, who originally wrote the
article cited in the Daily News of April 30, to use the term ' right wing people.'  ANC Deputy Mayor,
Logie Naidoo,even tried to claim that such terminology was commonplace and not discriminatory.
